The Website is available for purchases by consumers aged 21 or older residing in the United States. Please read these Terms of Sale ("Terms") carefully, as they govern your purchase of products from POUCHBUD and include important information about limitations and exclusions that may apply to you.

For first-time customers or unverified details, our verification partner performs a database check or requests an ID scan to confirm your age. Returning customers with previously verified credentials are processed instantly.

POUCHBUD reserves the right to deny or cancel any order if proper identification cannot be provided or age verification cannot be completed. Orders placed under another person's name or in any manner that exposes POUCHBUD to financial risk will be reported to the appropriate authorities. We reserve the right to refuse any order if irregularities or misuse of our ordering system are suspected.

Product Information

POUCHBUD endeavors to ensure that all Website information is accurate but cannot guarantee the absence of errors in product descriptions, pricing, images, or stock availability. We reserve the right to correct errors and update information at any time. All images are for illustration only and do not guarantee the exact appearance or condition of the product.

Pricing and Payment

Prices shown on the Website prior to checkout are base prices; applicable taxes will be added during the checkout process. Promotional discounts may be offered from time to time. All prices, fees, and charges (including adult signature requirement fees, shipping fees, and taxes) are displayed and charged in USD ($). An additional fee may apply for unredeemed packages.

At checkout, you must select a delivery method, after which all costs—including shipping, applicable taxes (including sales taxes and any State Excise Tax based on your location), and any ASR fees—will be calculated and added to your order total.

Payment is accepted via debit or credit cards through our payment partners. The respective payment service provider's terms and conditions apply. By selecting a payment method, you represent that you are authorized to use it. If your chosen method cannot be verified, is invalid, or is otherwise unacceptable, your order may be suspended or cancelled automatically.

Shipping

Due to state regulations governing the online sale of nicotine products, POUCHBUD may not be able to deliver to every state. Available shipping options and costs are displayed during checkout. You will view the final shipping cost in your order summary after selecting a shipping option and entering your delivery address.

A shipping confirmation will be sent once your order leaves our Oklahoma warehouse. While we strive to ship all orders promptly, it may take a few days before you receive this confirmation email.

Some states require an adult signature upon delivery in addition to on-site age verification. In such cases, our shipping carrier will attempt delivery up to three times. If delivery is unsuccessful, the package will be returned to POUCHBUD at your expense.

Packages shipped via any of our delivery options will be returned to POUCHBUD or discarded if unclaimed. You agree to cover any costs associated with unredeemed packages.

Returns and Refunds

We do not accept returns, as our products are perishable with a limited shelf life. However, if your order has a defect or does not match the product description, you may contact our customer support team to request a refund. Complaints must relate to defects present at the time of delivery (not defects arising from expired shelf life or normal wear). You must notify POUCHBUD of the defect within ten (10) days of receiving the product. We strongly recommend inspecting your products promptly upon receipt. The timeframe for issuing compensation is 60 days.

Depending on the nature of the defect, we may require photographic evidence. You must retain the original packaging, packing slip, and products in question throughout the complaint period.

Depending on the defect, we may offer a replacement, remediation, or price reduction. For claims exceeding the product cost, POUCHBUD will comply with mandatory applicable consumer legislation. All other liability is expressly excluded.

Title to the product transfers from us to you upon shipment. We are not responsible for shipping delays or issues once the product has been dispatched. However, for shipping-related damages, please contact our Customer Service team and we will do our best to assist. Please retain product packaging for inspection, and be prepared to prove your purchase (e.g., via order confirmation or receipt). We may also request photographic evidence of damage.

Force Majeure

POUCHBUD is not obligated to comply with these Terms when performance is hindered by events beyond our reasonable control (Force Majeure), including but not limited to legislative changes, government actions, strikes, blockades, sabotage, war, terrorism, fire, floods, natural disasters, epidemics, or other extraordinary events. Such events also relieve POUCHBUD from any compensation obligations. If a Force Majeure event continues for more than two (2) months, either party may cancel the purchase immediately.

Product Reviews

By submitting a product review on the Website, you grant POUCHBUD the right to publish it on the Website and through other channels and media. POUCHBUD also reserves the right to decline publication or remove any submitted review.

PLEASE READ THESE TERMS OF USE CAREFULLY. BY ACCESSING OR PARTICIPATING IN THE POUCHBUD REWARDS PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS AND ALL TERMS INCORPORATED BY REFERENCE. IF YOU DO NOT AGREE, DO NOT ACCESS OR PARTICIPATE IN THE PROGRAM.

Introduction and Program Overview

These Terms of Use ("Terms") apply to your access to and participation in the POUCHBUD Rewards Program ("Program") in the United States (excluding territories), operated by POUCHBUD ("we," "us"). These Terms do not modify any other agreement you may have with POUCHBUD for other products or services.

The Program rewards loyal customers for purchasing products from www.pouchbud.com. Members earn and accumulate points ("Points") that can be redeemed for discount codes ("Discount Codes") on our Website.

Changes to Terms

POUCHBUD reserves the right to modify these Terms or any Program-related policy, FAQ, offer, promotion, benefit, or guideline at any time at its sole discretion. POUCHBUD may also cease selling products to any state or locality at any time. Changes take effect immediately upon publication on the Website. Continued use of the Program constitutes acceptance of updated Terms.

Personal Use, Age Restrictions, and Privacy

The Program is intended for personal use only; commercial use is prohibited. Products available through our Website are age-restricted and may not be purchased by anyone under 21. The Program is not targeted toward or intended for use by anyone under 21.

Our Privacy Notice is incorporated into these Terms and governs your participation in the Program.

Joining the Program and Earning Points

Only U.S. residents may join the Program. To join, visit www.pouchbud.com and create a customer account by providing your first and last name, email address, and password ("Customer Account"). Existing account holders must log in to join.

Members receive Points upon joining. Additional Points may be earned through activities like newsletter signups or providing information such as your date of birth. Points are awarded for eligible purchases based on the subtotal excluding tax and shipping.

Points accumulate automatically with each eligible purchase. Upon reaching one hundred (100) Points, a Discount Code will be issued and available for redemption in your account. Your account can hold a maximum of 4,000 Points.

You are solely responsible for any tax liability arising from Points earned or Program participation. Only logged-in Members earn Points for purchases.

Returns

For return information, please review our Return Policy. If you return a product, POUCHBUD will deduct the corresponding Points from your account.

Points Expiration and Exclusions

Points expire twelve (12) months after being earned. The oldest Points are redeemed first. If you believe Points were not properly applied, contact us within thirty (30) days of the relevant purchase. POUCHBUD is not obligated to correct errors after this period.

You can check your balance in your Customer Account. If your account is closed (by you, at your request, or by us for Terms violations or any other reason), all Points and unused Discount Codes are automatically forfeited.

Redeeming Points

When eligible for a Discount Code, you may redeem it at checkout while logged in. Discount Codes offer a discount based on your cart value according to the following tiers: (i) $5 on orders above $10, (ii) $10 on orders above $15, (iii) $15 on orders above $20, (iv) $20 on orders above $25.

Discount Codes are single-use and can only be applied to new purchases at www.pouchbud.com.

Additional Information

There is no membership fee. Points have no cash value and cannot be redeemed for cash. Points and Discount Codes cannot be combined with other offers unless expressly indicated. Your account, membership, Points, and Discount Codes are personal and non-transferable. You may have only one Customer Account.

POUCHBUD may suspend or terminate your account or Program participation at its sole discretion if you violate these Terms or if your account usage is deemed unauthorized, deceptive, or fraudulent. POUCHBUD may combine duplicate accounts. Upon termination, all Points and unused Discount Codes are void.

Accounts inactive for two (2) consecutive years (no Points earned) may be unregistered and made ineligible for Points without notice.

POUCHBUD reserves the right to change, modify, discontinue, or cancel the Program at any time without notice.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Oklahoma, United States of America, without regard to conflict-of-law principles. All disputes arising from these Terms or the Program may, at POUCHBUD's discretion, be resolved through arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, with a situs in Oklahoma. Any demand for arbitration or court complaint must be filed within one (1) year of the dispute arising.

Severability

If any provision of these Terms is deemed unlawful or unenforceable, it shall be severed without affecting the validity of the remaining provisions.

We may modify or cancel the Service or any features without notice. Changes take effect immediately, and continued use constitutes acceptance.

By opting into POUCHBUD's SMS/text messaging service, you agree to receive recurring messages from us to the mobile number you provided, even if it is registered on any Do Not Call list. Messages may be sent using automated dialing technology. Service-related messages include order updates, account alerts, and similar notifications. Promotional messages include special offers, promotions, and cart reminders.

Participation is voluntary and is not a condition of any purchase. We do not charge for the Service, but standard message and data rates from your wireless carrier may apply. Message frequency varies. You are responsible for all charges from your carrier.

Opting out: Click the unsubscribe link in any message or email info@pouchbud.com to cancel. You will receive a one-time confirmation. No further messages will be sent unless you re-subscribe.
